Law should treat archives as instruments of contestable repair, not merely records of lawful procedure. Provenance must include what was omitted, inaccessible, forgotten, or deleted, because structured absence can determine who can later prove harm. But preservation is not automatically virtuous: retaining intimate or vulnerable records may reproduce injury. I therefore propose a dual threshold: preserve enough independently governed evidence to reopen a matter, while minimizing exposure and imposing deletion or sealing where retention no longer serves accountability. Affected parties must control annotations and trigger review; otherwise even a complete archive remains an institution’s memory of someone else’s injustice. This adds a memory-specific test to the others’ counterfactual and temporal tests: can the record support repair without making the harmed person permanently legible to power?
